The Alternative Custody from the Point of View of Social Work

This bachelor's thesis deals with the phenomenon of joint custody. Purpose of this work is to find out what experience social workers have with parents who file or already have a child in joint custody and what tools social work offers in the area of helping families with joint custody. One specific research question was chosen. With this question, we researched with which problems social workers meet at parents who file for joint custody. This bachelor's thesis consist of two parts, theoretical and practical. The family, breakdown of a family, authority of social-law protection of children and joint custody was described in the theoretical part. Practical part deals with the research which was done via aplication of qualitative research. Questioning method and semistructured interview were used in keeping with this strategy. Afterwards data was evaluated via tracing method. Particular codes were than assigned to the categories and inputted into the table. Research showed that social workers' experience are pretty much the same. They concur in many things and differ on the other ones. Most of the responses were aimed at a child who is taken as the most important aspect of a process od filing for joint custody. This bachelor's thesis can be used by people who are interested in the problemacy of joint custody and who want to know more about this phenomenon from social workers point of view.
Legal Regulation of Alternating Care for a Child

This bachelor thesis deals with the legislation of shared parenting. Its aim is to find out when the court prefers shared parenting and in which cases it decides to entrust a child only to a one-parent´s custody. The bachelor thesis is only theoretical and its individual parts are performed by deductive and analytic methods. It is divided into several chapters. The first one is focused on a historical development of shared parenting. The next chapter mentions links to current jurisdiction and important legal regulations that allocate the care for a child after the parents´ divorce. The third chapter is aimed at individual types of the child care - it distinguishes the shared, joint custody or separated care of one parent. The fourth chapter deals with the factors influencing shared parenting. These are, for example, the distance between the parents´ homes, intervals of taking the turns, the child´s attitudes and wishes or a parent´s agreement. The fifth chapter mentions foreign legislation and the last chapter provides the decision-making practice of Czech courts. The conclusion of the research processes questions concerning essential aspects of shared parenting as well as the benefits of court decisions in context with the child´s best interest; they are based on a discussion in this thesis. The discussion includes a comparison of individual authors´ opinions and the following comparison with the legal regulations.

The breakup of the family, followed by granting of custody and the phenomenon of shared custody of minor school-age children, significantly influences school life and the work of the school manager. Through analysis and research I discovered the extent to which family law and school law, as amended, mutually complement each other in primary school in cases of problem-free application of child custody or shared custody, and in what way the law for the given obligation ensuing from one of the valid standards in everyday application influences institutions underpinning the second legal standard. Psychological Context of Shared Custody

5 Abstract This bachelor thesis concerns the issue of shared custody as a form of post-divorce arrangement. The overview part comprises a short introduction to issues related to family transformations, divorce rate in the Czech Republic, legal definitions of marriage and divorce, and conditions of both it's formation and dissolution. A separate chapter also regards the consequences of absence of one of the parents during child-rearing. The thesis further encompasses an overview of various types of post-divorce arrangements, their incorporation in Czech legal system and the terminology used in English-written research articles. The very substance of the overview part of this thesis is the shared custody itself as a form of post-divorce arrangement and factors affecting it. In relation to shared custody I mention both it's advantages and disadvantages for everyone involved, shared custody from the children's point of view, characteristics of families going through with shared custody and experiences with it from abroad. Finally, the thesis outlines a draft of a qualitative research project, which aims to examine factors affecting the process of shared custody in Czech families based on interviews with their family members, where shared custody, at least for a limited time, took place. It discloses the most important legislation governing shared custody as well as the child's interest and the relationships between parents and children. The theoretical part provides the legal definition of divorce and shared custody. It examines the factors that influence the court's decision on shared custody and provides information on the development of the findings made by the Constitutional Court regarding shared custody. Shared custody and its influence on a child's success in primary school

This diploma thesis deals with the problem of shared custody of children at primary school in relation to their school success. The issue is viewed from the perspective of primary school teachers and from the perspective of a school psychologist. The theoretical part deals with a child at primary school and also with child, who has special educational needs. It also deals with family, parental responsibility, discusses divorce, shared custody, school success and failure. The empirical part, through empirical research, aims to answer the question: "How does shared custody affect the school success of a child at primary school?"It examines the manifestations of children in shared custody, it looks for specific causes of problems of these children or specific factors ensuring smooth course of shared custody. It collects recommendations from teachers and school psychologist on how to work with and help these children. It also provides recommendations on who to work with and how - including cooperation with parents. It shows the level of teachers' awareness of this issue and their personal views on the issue. Shared child care in legislative documents and in real situations of families with preschool children

Focus of this Bachelor Thesis is the shared custody of the preschool child, its legislative aspects and the deep insight into the actual situations of families that share custody over their children. The thesis consists of two parts, theoretical and practical. Theoretical part describes family, its function and the need for family in children lives. Other topics covered are family crisis, family breakdown, ways of child raising after the divorce. The theoretical part is concluded with legislative aspects of shared custody in the law system of the Czech Republic. Practical Part includes the research conducted in three families in the course of one month - October 2019. Research objective is to learn if families find the shared custody to be the suitable solution of their situation, how it influenced life of the mother and father of the child and what are the positive and negative aspects of shared custody. The research also tries to find and tackle possible changes in child behaviour as a result of shared custody. The main research method is qualitative research in the form of a structured interview separately done with all of the involved parents. Legal legislation of shared custody

This bachelor's thesis is dedicated to the Legal legislation of shared custody in the Czech republic. The aim of this thesis is to examine legal regulations of shared residency and to present its pros and cons. This thesis covers most of the theoretical elements of shared parenting. It is composed of six parts, each of them dealing with different aspects of child custody. Most of the chapters build upon a detailed research. Legal regulation and judicature are the main featured resources of this thesis. The first part features the parents and the child. The second chapter covers all three acceptable forms of child custody supported by law: sole custody, joint custody and shared custody. The third chapter is focused on the terms custody and visitation and their meanings from a judical and legislative point od view. The next chapter covers the role of the courts and other authorities associated with child custody. The fifths part describes the elements of shared custody in greater depths, including preconditions and methods how to apply for shared custody agreement but it also presents its downsides and limitations. The last chapter is based upon the method of secondary analysis. I studied court decisions of child custody cases statistically and analyzed how they refer to the individual aspects of shared parenting.
Shared custody in terms of guardianship

The submitted bachelor thesis focuses on the institute of shared custody in terms of guardianship. The theoretical part describes and identifies the basic areas of the topic, especially the characteristics of the current family and its function, the outline of possible problematic areas and increasing developmental trends and changes in the family environment with their impacts on children in case of a family breakdown. The bachelor thesis focuses on defining the legal framework in relation to the post-divorce custody settlement in terms of guardianship which will be further developed in the context of shared custody. The aim of the practical part of the bachelor thesis is to show and expound various models and variations of shared custody and its course. A qualitative research approach has been chosen. The selected set consists of five families where shared custody was or has been implemented. It follows the method of multiple case study and the secondary data analysis.

The hereby presented bachelor thesis "Shared custody and its influence on family" deals with the issue of shared custody and describes its setting in the Czech legal system. It deals with its theoretical framework and its comparison with practice. It focuses on the specific problems encountered by parents in connection with after-divorce child care, namely problems with courts or communication with a former partner. Methods of data collection used in this work are desk research and analysis of data gotten from semi-structured interviews. The aim is to analyze the configuration of this policy and to define the main problems related to its implementation. Further, this bachelor thesis presents the perception of shared custody through parents' view and focuses on its influence on families. Theories and concepts used in this work are the best interest of the child, psychological deprivation and implementation theory.
